RAF CLAIMS

If you have been injured in a motor vehicle collision which was not your fault you may very well be entitled to claim your damages or a portion thereof from the Road Accident Fund.

The heads of damages claimable from the RAF are:

Past loss of income
Future loss of income or earning capacity

In law, one's conduct is measured against the conduct of the reasonable man. If such conduct is unreasonable when compared to that of the “reasonable man” then the damage caused may be actionable.

Professionals have a higher duty of care by virtue of their expertise in their given field or fields.

If their conduct falls outside that which is considered reasonable and you suffer damages as a result, then such damages may be actionable.
